International Arbitration Court "AG Arbitration Court"​

AG Arbitration Court carries out its activity in accordance with International Conventions in the sphere of arbitration, the Constitution of the Republic of Kazakhstan, the Civil Code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan «On Arbitration», other legal acts, international treaties, Regulation of AG Arbitration Court «On Arbitration Fees and Expenses», Rules of AG Arbitration Court.

The appeal to the Arbitration Court is an expression of the most important principle of private, civil law — non-interference of anyone, including the state, in private affairs (Article 2 of the Civil Code of the Republic of Kazakhstan). At the same time the state court when issuing a ruling on the issuance of a writ of execution, the decision of the arbitration court is not entitled to check the correctness and legality of such decision on the merits, the State Court is neither a cassation, appeal, nor a supervisory instance for the arbitration court. The State Court decides only on the issue of a writ of execution for compulsory enforcement of an arbitral award.

The main advantages of arbitration are confidentiality of proceedings, speed and economy of the process, impartiality and objectivity.

Thus, AG Arbitration Court has all the rights of a legal entity with full financial and economic independence and the apparatus allowing it to effectively exercise the functions of organizing arbitration activities entrusted to it by the legislation of the Republic of Kazakhstan and the Rules.
